The petitioner seeks bail in Bijaipur P.S. Case No. 127 of 2017 registered under Section 379 of the Indian Penal Code.

Three unknown miscreants are said to have looted the motorcycle of the informant.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. No incriminating article has been recovered from the conscious physical possession of the petitioner. He was not put on T.I.P. He has been falsely implicated in this case. He has no concern with the aforesaid occurrence. There is nothing in the record indicating the

Patna High Court Cr.Misc. No.16232 of 2018 (03) dt.17-05-2018 - 2 - complicity of the petitioner in the occurrence barring his confessional statement which has no evidentiary value in the eye of law. The petitioner has been languishing in custody since 06.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Gopalganj in connection with Bijaipur P.S. Case No.127 of 2017.
