Petitioner, already in custody, seeks bail in connection with Naugachia P.S. Case No.103 of 2017, giving rise to Sessions Trial No.783 of 2017, registered under Sections 302 and 120B/34 of the Indian Penal Code.

Allegation in brief is that the petitioner along with Babloo Kumar Sharma killed the informant's brother by throttling due to some family dispute.

Learned counsel for the petitioner submits that there is land dispute between both sides, both sides are agnates and other coaccused has been granted bail. Learned counsel for the State submits that there is specific allegation against this petitioner and one Babloo Kumar Sharma

Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected for the present in connection with Naugachia P.S. Case No.103 of 2017, giving rise to Sessions Trial No.783 of 2017, pending in the court of learned 2nd Additional District & Sessions Judge, Naugachia. However, the trial court is directed to expedite the trial and preferably conclude the same within a year.
