This is a case registered under Section 396 of the Indian Penal Code in connection with Barahara P.S Case no 338 of 2017 pending in the court of Chief Judicial Magistrate, Bhojpur at Ara.

The petitioner's counsel submits that he is not named in the FIR and he has falsely been implicated in this case merely on the basis of suspicion.

The case diary had earlier been called for. The investigation reveals that the petitioner's mobile number was used for making call to the number of Sourabh Kumar, the deceased. The said Sourabh Kumar has been done to death by causing

Patna High Court Cr.Misc. No.17528 of 2018 (3) dt.03-05-2018 2/2 firearm injury.

Considering the seriousness of the allegations against the petitioner, this Court, for the present, is not inclined to enlarge the petitioner on bail.

The prayer for bail is rejected.
