Petitioner, already in custody, seeks bail in connection with Manihari PS Case No.466 of 2017, registered under Sections 363/364 of the Indian Penal Code.
Allegation in brief is that the husband of the informant along with one Md. Faizul were abducted by Mohan Thakur and his 10-11 unknown gang members for ransom and later on the dead body of the husband of the informant was recovered.
Learned counsel for the petitioner submits that the FIR is against one Mohan Thakur and 10-11 unknown persons. The petitioner is not named in the FIR. Later on it is alleged by
Patna High Court Cr.Misc. No.15133 of 2018(3) dt.10-05-2018 2/2 the informant and Faizul that this petitioner was also there as a member of the gang of Mohan Thakur, the petitioner has no criminal antecedent except one case under Section 498A of the Indian Penal Code and evidence is that there was dispute regarding taking out of the fish from the pond in between the deceased and Mohan Thakur.
Having considered the aforesaid facts and circumstances, petitioner Md. Jamshed Alam is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Katihar in connection with Manihari PS Case No.466 of 2017.
