Earlier the bail application of petitioner was rejected vide order dated 03.02.2022 passed in Cr. Misc. No. 40561 of 2021. Vide order dated 11.01.2023, report was called for regarding the stage of trial and the same has been received, which reveals that the case is running for prosecution evidence. Out of five chargesheeted witnesses one witness has been examined.

Considering the nature of accusation and progress of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

However, trial court is directed to conclude the trial preferably within a period of one year.
