JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Guthani P. S. Case No. 51 of 2019, disclosing offences under Sections 147, 148, 149, 323, 324, 307, 379, 504, 506 of IPC.
There is specific allegation against other accused persons of assault to the informant and so far this petitioner is concerned, there is allegation that he and one co-accused Arvind Yadav assaulted by rod to one Lalmati Devi Submission of the learned counsel for the petitioner is that with respect to playing of Holi the scuffle took place. No specific allegation has been attributed against the petitioner. There is case and counter case between the parties. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,
Patna High Court CR. MISC. No.60247 of 2019(2) dt.24-09-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Siwan, in connection with Guthani P. S. Case No. 51 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
