The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 47(a) of the Bihar Prohibition & Excise Act. There is recovery of 680 litres of illicit country made liquor, 105 litres of spirit and other articles used for manufacturing illicit liquor from the orchard of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious

Moreover, for the alleged seizure of 16.08.2013, the prosecution report had been sent to the Court after 33 days without explaining the delay. Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that the prosecution report suggests that huge quantity of illicit liquor was recovered from the orchard of the petitioner. Considering the fact that petitioner is owner of orchard from where huge quantity of illicit liquor was recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail to the petitioner stands rejected.
