The petitioner seeks bail in Hathauri P.S. Case No. 13 of 2017 registered for the offence punishable under Sections 356 and 379 of the Indian Penal Code.
Allegation against the petitioner is of committing theft. It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case due to enmity. It has further been submitted that petitioner is not named in the FIR and nothing incriminating article had been recovered from his possession. Similarly situated co-accused persons have been granted bail by a co-ordinate bench of this Court vide order dated 21.08.2017 in Criminal Miscellaneous No. 38678 of 2017 and 01.09.2017 in Criminal Miscellaneous No. 38500 of
Patna High Court Cr.Misc. No.1570 of 2018(3) dt.07-02-2018 2/2 2017. Petitioner is in custody since 23.03.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. cum-Sub Judge, 10th, Muzaffarpur in connection with Hathauri P.S. Case No.13 of 2017.
