Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Begusarai Town P.S. Case No. 412 of 2022 disclosing offence punishable under Sections 385/427 of the Indian Penal Code and Sections 25(1b)a/26/35 of the Arms Act. It is the prosecution's case that based on secret information to the effect that certain criminals had assembled to commit a major crime, a raid was conducted by the police where five to six persons were found sitting together. On seeing the police, they had started running away and on chase, two of them, namely, Sanjeev Kumar and Saurabh Kumar were apprehended. From the possession

Patna High Court CR. MISC. No.65171 of 2022(2) dt.04-03-2023 2/2 of Sanjeev Kumar, the police, it is said, recovered one country made pistol and one live cartridge. The persons apprehended are said to have disclosed to the police that they had intended to commit some crime and further that this petitioner was also one amongst them when the raid was conducted.

Learned counsel appearing on behalf of the petitioner has submitted that with similar allegation against co-accused Shyam Kumar and Saurabh Kumar, this Court has directed for their release on bail by orders dated 22.02.2023 passed in Cr. Misc. No.63019 of 2022 and 20.02.2023 passed in Cr. Misc. No.63154 of 2022, respectively.

Considering the aforesaid submission and the nature of accusation, a case is made out for release of the petitioner on regular bail. This application, is, accordingly, allowed. Let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in Begusarai Town P.S.
