====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 10-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Special (N.D.P.S.) P.S. Case No. 191 of 2021 arising out of Dhanarua P.S. Case No. 415 of 2021, registered for the offences punishable under Sections 20(b)(ii)(c) and 29 of the N.D.P.S. Act.

3. The recovery is of 59 kg of ganja from the vehicle in which the petitioner, along with co-accused Dinesh Kumar Sharma and Arun Kumar Shrivastava, was found sitting. The petitioner is in custody since 01.12.2021. The trial has not yet concluded.

4. A similarly situated co-accused, Dinesh Kumar Sharma, has been granted bail by the Hon'ble Supreme Court in

Patna High Court CR. MISC. No.66708 of 2025(3) dt.10-12-2025 2/3 Criminal Appeal No. 919 of 2025.

5. The order dated 24.02.2025 reads as follows:- "1. Leave granted.

2. Heard learned counsel for the parties.

3. 59 Kgs. of ganja in 30 packets is alleged to have been recovered from the vehicle. The appellant is in custody since 01.12.2021. The charge sheet was filed way back on 05.02.2022 but so far only two witnesses out of seven witnesses have been examined.

4. Though, learned counsel for the respondent-State submits that the remaining witnesses would be examined within four months, we are of the view that such examination would not be possible soon.

5. Looking to the entirety of the facts and circumstances of the case, we consider it appropriate to enlarge the appellant on bail subject to such terms and conditions as may be imposed by the trial Court.

6. The order dated 09.08.2024 passed by the High Court is quashed and set aside.

7. The appeal is allowed accordingly.

Pending application(s), if any, shall stand disposed of."

6. Considering the nature of the allegations and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail

Patna High Court CR. MISC. No.66708 of 2025(3) dt.10-12-2025 3/3 on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court (NDPS) No. II, Patna/ concerned Court below in connection with Special Case No. 191 of 2021 arising out of Dhanarua P.S. Case No. 415 of 2021.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed in the trial. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
