2. This application has been filed on behalf of the petitioner for setting aside the order dated 8.12.2021 passed by the learned ACJM-V-cum-Incharge CJM, Biharsharif, Nalanda in Bihar P.S. Case No. 770 of 2021 registered for the offence under Sections 498(A)/34 of the Indian Penal Code and under

Patna High Court CR. MISC. No.79681 of 2023(2) dt.24-07-2026 2/3 Section 3⁄4 of the D.P. Act by which the Court below has granted provisional regular bail to the opposite party no. 03 to 05.

3. It has been submitted by the learned counsel for the petitioner that the accused persons have obtained bail by filing a false compromise petition without consent and signature of the informant.

4. I have perused the impugned order granting bail to the opposite party no. 02 to 05 and do not find any error in the said order. Further, the petitioner has not been able to show any good ground to interfere with the impugned order granting bail to the opposite party no. 02 to 05. Hence, no ground for cancellation of bail is made out.

5. Accordingly, this cancellation bail application is rejected. However, the trial Court is directed to conclude the trial of the case arising out of Bihar P.S. Case No. 770 of 2021 within six months from today by holding the trial on day to day basis. He is also directed to file a compliance report in this Court after six months or after conclusion of the trial, whichever is earlier.

6. It is also directed that if any matrimonial case is pending in the Court of Principal Judge, Family Court, Biharsharif at Nalanda then the same shall also be disposed of

7. Let a copy of this order be communicated to the learned Principal District and Sessions Judge, Nalanda through FAX for its compliance.
