Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. The petitioner is in custody since 28.07.2017. Allegation is that a loaded country made pistol was recovered from possession of the petitioner.
Submission is that the petitioner and others were preparing to commit some dacoity.
Submission is that petitioner has got no criminal antecedent.
The report of the learned trial Judge would reveal that charges have already been framed and petitioner is ready to

Considering the aforesaid fact and the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Naugachia Police Station Case No. 163 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
