Petitioner, already in custody, seeks bail in connection with Gandhi Maidan PS Case No.154 of 2017, registered under Sections 408 and 420/34 of the Indian Penal Code. Allegation in brief is that the informant's company handed over Rs.2,08,300/- to the petitioner for depositing in the ICICI Bank as the informant's company was working as a collecting agent of EMI of the loan amount given by ICICI Bank and the petitioner was an employee in the company of the informant.

Learned counsel for the petitioner submits that there is no document showing acknowledgment of Rs.2,08,300/- from the informant for depositing the same in the ICICI Bank and the

Patna High Court Cr.Misc. No.21588 of 2018(4) dt.18-05-2018 2/2 petitioner has been implicated due to dispute with his employer and he is in custody since 16.01.2018.

Having considered the aforesaid facts and circumstances, petitioner Sameer Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Patna in connection with Gandhi Maidan PS Case No.154 of 2017.
