JUSTICE BIRENDRA KUMAR ORAL ORDER 26-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 341/323/324/379/ 354/ 504 / 307/34 of the Indian Penal Code.

For land dispute the petitioner and co-accused Krishna Rai are alleged to have caused injury with farsa on the head.

Submission is that there is case and counter case. Petitioner is in custody since 31.01.2018.

Considering the nature of allegation and the period already undergone by the petitioner and the fact that he has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand)

Patna High Court Cr.Misc. No.19143 of 2018 (4) dt.26-06-2018 with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sahajitpur P.S. Case No.118 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
