Petitioner is in custody in connection with Amas P.S. Case No. 154 of 2019 for the offence under section 272, 273, of the Indian Penal Code and Section 30(a), 56(b) of Bihar Excise and Prohibition Act, 2016.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

Learned counsel for the petitioner submits that in the instant case total 240 liters of country made liquor was seized. Learned counsel for the petitioner submits that petitioner is in custody since 9.8.2019.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner,

Patna High Court CR. MISC. No.60856 of 2019(2) dt.30-09-2019 2/2 let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Amas P.S. Case No. 154 of 2019 subject to the condition that the petitioner shall deposit Rs. 50,000/- cash in the court below and the amount of Rs. 50,000/- deposited before the court below shall abide by the final outcome of the pending case.
