The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Jamui (Adarsh) P.S. Case No. 190 of 2019 registered for the offence punishable under Sections 341, 323, 307, 429 and 302/34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein having assaulted the father of the informant namely Bechan Tanti by means of lathi and khanti resulting in the father of the informant receiving head injury whereafter during the course of treatment at the hospital, he

The learned counsel for the petitioner submits that the petitioner is languishing in custody since 16.04.2019, is having a clean antecedent and charge sheet has already been submitted in the present case, hence no prejudice would be caused to the prosecution if the petitioner is released on regular bail. Lastly, it is submitted that similarly situated co-accused persons have already been granted regular bail vide orders dated 26.08.2019 and 23.10.2019 passed by a coordinate Bench of this Court in Criminal Misc. No. 53339 of 2019 and Criminal Misc. No. 58515 of 2019.

Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui (Adarsh) P.S. Case No. 190 of 2019.
