KUMAR ORAL ORDER 12-02-2018 Heard the counsel for the petitioner and the A.P.P. for the State assisted by the counsel for the informant. Petitioner seeks regular bail in L.N.M.U. P.S. Case No.5 of 2017 instituted for the offence under Section 304 (B), 201/34 of the I.P.C.
Informant is brother of deceased Rozy Kumari who in his written complaint has stated that marriage of deceased sister was solemnized with petitioner on 13.12.2013 with Hindu rites and rituals and presents, gifts and amount in cash were given to her in-laws at the time of marriage but they used to demand more dowry and for non-fulfillment of which her sister was subjected to harassment and torture by her in-laws.

No.3047 of 2018 (3) dt.12-02-2018 2/3 It has been further alleged that on 9.1.2017 her further at Delhi received phone call from father of petitioner at 7.00 A.M. that her daughter Rozy Kumary is missing from the house from morning after leaving her daughter and informant thereafter came to matrimonial house of her sister and could not find her sister in the house and alleged that she has been killed by her in-laws and her dead body has been concealed.
It has been submitted by the Senior counsel that petitioner is innocent and has been falsely implicated in this case on suspicion only. He is an officer in the State Bank of India and posted at Alipurduar (Baro bisha Branch), Assam and at the time of occurrence he was not in his house but was present at his place of posting which is established by the call details of petitioner. There is general and omnibus allegation against family members which included husband (petitioner), father-in-law, mother-in-law, brother -in-law, married sister-in-law and nandoshi, and father and mother of petitioner have been granted regular bail in Cr.Misc. No.11530 dated 28.4.2017 whereas brother, married sister and nandoshi have been granted Anticipatory Bail. It has further been submitted that body of deceased Rozy Kumari was recovered after two days of F.I.R. from pond and no injury was found on her body and from viscera
Patna High Court Cr.Misc. No.3047 of 2018 (3) dt.12-02-2018 3/3 report cause of death is said to be poison and circumstances and Post mortem report suggests it to be a case of suicide. Charge sheet has been submitted. Petitioner has no criminal antecedent. Bail petition of petitioner was vehemently opposed by the counsel for the informant.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Darbhanga, in L.N.M.U P.S.Case No.5 of 2017.
