The petitioner is in custody in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise (Amended) Act, 2016, (Act), 2018. Allegedly, it is a case of recovery of 1494.78 liters of illicit liquor from an orchard of one Arjun Singh. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that he has no concern with the seized liquor and no any incriminating article has been recovered from the conscious possession of the petitioner as well as petitioner is in judicial custody since 05.10.2022 and petitioner has clean antecedent.

No.69459 of 2022(2) dt.06-01-2023 2/2 Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise)-02, Samastipur in connection with Sarairanjan P.S. Case No. 196 of 2021.
