Petitioner is apprehending his arrest in connection with Paliganj P.S.Case No.134 of 2019, registered for offences punishable under Sections 341, 323, 379, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act. As per the allegation, petitioner and other accused persons stopped the tractor of the informant and also assaulted the informant as well as took away Rs.30,000/- and they made firing also. Apart from the above, allegation is that the petitioner is accused in one more case, which appears from para no.3 of the petition. The occurrence is with respect to dispute of the loading of the sand.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.60680 of 2019(2) dt.24-09-2019 2/2 that they have been falsely implicated in this case and no specific allegation has been made against him and the dispute is with respect to mining of the sand.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Danapur, Patna in connection with Paliganj P.S.Case No.134 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
