JUSTICE ARUN KUMAR ORAL ORDER 25-06-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The Petitioner, already in custody, seeks bail in connection with Kotwa P. S. Case No. 03 of 2018, registered under Sections 379 & 34 of the Indian Penal Code. The allegation in brief is that when the informant parked his motorcycle in the way of returning his home, three persons came there and took away his motorcycle. During investigation, the motorcycle was recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that this is not a case of robbery and the allegation is totally false and concocted. It is submitted that the petitioner is not named in the

Patna High Court Cr.Misc. No.25582 of 2018 (3) dt.25-06-2018 2/2 F.I.R. and nothing has been recovered from the conscious possession of the petitioner and the petitioner is in custody since 14.01.2018.

Having considered the said facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-10, East Champaran at Mothihari, in connection with Kotwa P.S.Case No. 03 of 2018.
