JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Parbatta (Bharatkhand) P.S. Case No. 317 of 2017 registered for the offences punishable under Sections 147, 149, 153, 341, 323, 188, 120B, 504, 353 and 109 of the Indian Penal Code.

Allegation against the accused persons, including the petitioners is that they were protesting for installation of transformer in spite of the fact that there was proclamation under Section 144 Cr.P.C. and they were also raising speech and disturbing the communal harmony there.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.60681 of 2019(2) dt.24-09-2019 2/2 that no specific allegation has been attributed against them. Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that petitioners are accused in several other cases.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioners. However, if they surrender and pray for regular bail, the same shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.

With the above observation, this application is disposed of.
