Petitioner seeks bail in a case registered under Section 414 of Indian Penal Code.

It is submitted by the petitioner's counsel that he has no connection with the motorcycle in question and that his signature has falsely been obtained on the plain papers. He disputes the fact of seizure by submitting that the seizure list contains signature of only the raiding party. The same falsifies the entire prosecution case. Prior to the instant case, he is having no criminal antecedent and on basis of such false implication, he is in custody since 19.09.2017. Charge sheet has been submitted and investigation is also complete in this case.

Considering the aforesaid submissions, prayer for

Patna High Court Cr.Misc. No.663 of 2018 (2) dt.11-01-2018 2/2 bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate -cum- CBI -II, Patna in Parsa Bazar Police Station Case No 203 of 2017 subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
