The petitioner seeks regular bail in connection with Sessions Trial No.177 of 2018 arising out of Parsa Bazar P.S. Case No.134 of 2017 registered for the offences punishable under Sections 304B, 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
It has been submitted that the petitioner is father-inlaw of the deceased. The allegation of demand of motorcycle is omnibus. In F.I.R. the informant (father of the deceased) has alleged that his son-in-law and other co-accused used to demand money for purchasing a motorcycle. Patna High Court Cr.Misc. No.29900 of 2018 (4) dt.02-07-2018 cremated in presence of the informant and U.D. Case No.04 of 2017 was registered on the information of husband of the deceased. There is also a delay of two weeks in lodging F.I.R. The petitioner is residing separately having no concern. The petitioner is in custody since 12.03.2018.
The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge I, Patna in connection with Sessions Trial No.177 of 2018 arising out of Parsa Bazar P.S. Case No.134 of 2017.
