1. Heard learned counsel for the petitioner and the learned A.P.P. for the State as well as learned counsel appearing on behalf of the informant.

2. The petitioner apprehends his arrest in connection with Dariyapur P.S. Case No. 138 of 2023 registered under Section 307 and other allied sections of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. There is case and counter case between the parties. The specific allegation is against the co-accused Ramayan Rai and Pankaj Rai. Further he submits that petitioner has no criminal antecedent.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of A.C.J.M.- XIII, Saran at Chapra in connection with Dariyapur P.S. Case No. 138 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
