The petitioner seeks bail in a case instituted for the offences under Sections 376(D), 365, 506, 34 of the Indian Penal Code and Section 4 of the POCSO Act.
This is the third attempt for bail on behalf of the petitioner. Earlier the bail application was rejected vide Annexure-1 and 1/A taking into account the victim girl was examined under Section 164 Cr.P.C. and had supported the prosecution case.
A report was called for from the Court below. The same has been received from the Court below vide letter dated 21.4.2018 (at Flag-P). It has been reported that the case is at the stage of argument and it could be concluded within a period of
Patna High Court Cr.Misc. No.2550 of 2018(3) dt.27-04-2018 2/2 15 days subject to co-operation of the parties. Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. However, The Trial Court is directed to take all necessary steps to conclude the trial preferably within two months from the date of receipt/production of a copy of this order. It is expected that the prosecution and the defence will cooperate in the trial of the case.
