The petitioner seeks bail in connection with Pasraha P.S. Case No. 42 of 2018 registered for the offence punishable under Sections 414 of the Indian Penal Code.
Allegation against the petitioner is of recovery of one stolen motorcycle from his possession.
It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. It has been further submitted that the name of the petitioner has transpired only on the basis of confessional statement of co-accused Prashant Kumar, who has already been granted bail. Similarly situated co-accused persons namely, Prashant Kumar and Santosh Kumar have already been granted
Patna High Court Cr.Misc. No.32951 of 2018(4) dt.13-08-2018 2/2 bail by a co-ordinate bench of this Court vide order dated 17.05.2018 in Criminal Miscellaneous No. 30565 of 2018 and dated 31.05.2018 passed in Criminal Miscellaneous No. 31775 of 2018. Petitioner has got no criminal antecedent and is in custody since 06.04.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Pasraha P.S. Case No. 42 of 2018.
