The petitioner, who is in custody, seeks bail in connection with Ismailpur P.S. Case No. 31 of 2014 registered for the offence punishable under Sections 147, 148, 149, 341, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The FIR was lodged against ten named accused persons and five to six unknown persons. It is alleged in the FIR that all the accused made indiscriminate firing causing death of the informant's brother. The postmortem report of the deceased reveals that two gun shot injuries were found on his person. It has been submitted that similarly situated co-accused persons, namely Rajesh Mandal and Arvind Yadav have already been

Patna High Court Cr.Misc. No.35893 of 2018(4) dt.24-08-2018 2/2 granted bail by different Benches of this Court and co-accused namely, Sarbin Yadav has been granted bail by this Hon'ble Court vide order dated 22.01.2018 passed in Cr. Misc. No. 2016 of 2016. Petitioner is in custody since 11.01.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Naugachhia, in connection with Ismailpur P.S. Case No. 31 of 2014.
