The petitioner, who is in custody, seeks bail in connection with Punpun P.S. Case No. 328 of 2017 in S.Tr. No. 146 of 2018 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code. Informant is the father of deceased, who in his written complaint has stated that marriage of petitioner was solemnized with the daughter of informant in 2005 and sufficient cash and presents were given to the petitioner. From last one year the petitioner was demanding Rs. 1,00000/- as dowry to construct his house and due to non-fulfillment of said demand petitioner and other family members killed his daughter.

No.35686 of 2018(4) dt.21-08-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case only on the basis of suspicion. His wife died due to diarrhoea and she was rushed to hospital for her treatment but inspite of best efforts she could not be saved. During her treatment informant and his family were informed by telephone. Two sons and one daughter were born from the said wedlock and after 13 years of marriage demand of dowry cannot be believed. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 18.09.2017.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge-XI, Patna in connection with Punpun P.S. Case No. 328 of 2017 arising out of S. Tr. No. 146 of 2018. (S. Kumar, J.) Rajiv/- U T
