The petitioner seeks bail in Beldaur P.S. Case No. 10 of 2018 registered for the offence punishable under Sections 25(1-B)a, 26(i) (ii) of the Arms Act.

Informant is a police officer who in his written report dated 13.01.2018, has stated that he was on evening patrolling duty and at about 6:00 pm he received secret information from the Officer-in-charge of Beldaur P.S that one Garib Mandal in his house is moving with loaded revolver and when the informant reached at the place, he tried to flee away but was chased and apprehended by the police and on search of petitioner one loaded country made pistol and 28 live cartridges were recovered from his possession.

Patna High Court Cr.Misc. No.35010 of 2018(3) dt.16-08-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Petitioner has got no criminal antecedent and is in custody since 15.01.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-3rd, Khagaria, in connection with Beldaur P.S.
