====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 08-08-2018 Heard Sri Ajay Kumar Tiwari, learned counsel for the petitioner and Sri Akshay Lal Pandit, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since month of January,2018 in Sasaram ( Mufassil) P.S. Case No.1716 of 2017 registered for the offence under Section 366(A)/34 of the Indian Penal Code, has prayed for grant of bail.

In this case, earlier case diary was called for from the court below, which has been received.

Learned counsel for the petitioner submits that save and except the fact that the petitioner has been arrayed as one of the accused in the F.I.R., there is no other material to connect the petitioner. He further submits that the daughter of the

No.33882 of 2018(5) dt.08-08-2018 2/2 informant had eloped with Prakash Kumar Pal, with whom she after solemnising marriage is residing peacefully, which fact has been stated by the victim herself by way of filing a petition in the present police case before the court below. He further submits that other three accused persons, who were none else, but close relative of co-accused Prakash Kumar Pal, have already been granted anticipatory bail by the court below. Sri Akshay Lal Pandit, learned Addl. Public Prosecutor , though, has opposed the prayer for bail, he has not disputed the fact that during investigation it has come that the daughter of the informant ( victim) was in love with Prakash Kumar Pal since about last three years.

Considering the facts and circumstances, let the petitioner, namely,Guddu @ Dhulmul Paswan @ Dhuldhul Paswan @ Ghulghul Paswan @ Ghulmul Paswan be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram in connection with Sasaram (Mufassil ) P.S.
