Petitioner claims that, on his raiyati land, a road has been constructed by the Gram Panchayat at the behest of the Mukhiya.
Accordingly, this writ application stands disposed of with a liberty to the petitioner to move before the District Magistrate,
Patna High Court CWJC No.1531 of 2017 dt.10-02-2017 2 / 2 Sitamahi by filing a detailed representation setting out his claim along with copies of the documents in support thereof. On such representation being filed, let the District Magistrate examine the matter and if it is found that the petitioner's land has been utilized for construction of road then he will immediately refer the matter to the Secretary, Rural Works Department, who shall ensure that either the land is acquired in accordance with law after granting compensation to the petitioner or such construction from the land of the petitioner is removed forthwith. The entire exercise should be completed within a period of three months from the date of filing of such representation.
