1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant, Mr. Arun Kumar.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 354-B, 504, 506, 120-B and 34 of the Indian Penal Code read with Sections 4 and 6 of the POCSO Act.
3. Learned counsel for the petitioner submits that petitioner herein along with Mishrilal Baitha had moved this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 60549 of 2024. It is submitted that during pendency of Criminal Miscellaneous No. 60549 of 2024, the petitioner herein was arrested, as such, Criminal Miscellaneous No. 60549
Patna High Court CR. MISC. No.72954 of 2024(2) dt.20-12-2024 2/2 of 2024 was withdrawn on his behalf. It is further submitted that Mishrilal Baitha was granted the privilege of anticipatory bail by order dated 28.08.2024 in Criminal Miscellaneous No. 60549 of 2024. It is further submitted that the case was considered on merits and in detail while granting anticipatory bail to Mishrilal Baitha and the case of the petitioner is on similar footing and the petitioner is in custody since 04.08.2024 and has antecedent of one case which was instituted by the side of the informant.
4. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant oppose the prayer for regular bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Motihari Mahila P.S. Case No. 13 of 2024.
