The petitioner is accused in connection with Buxar (Industrial Area) P.S. Case No. 212 of 2016 registered under sections 414 of the I.P.C. and 20(b)ii(c)/22/27A/29 of the N.D.P.S. Act pending in the Court of Special Judge, Buxar. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has committed no offence. It is also submitted that petitioner is in custody since 19.12.2016, having no criminal antecedent.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is specific allegation against the petitioner about the recovery of
Patna High Court Cr.Misc. No.6606 of 2017 (3) dt.18-03-2017 2/2 huge quantity of ganja.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Arvind Srivastava, J) Shailendra/- U T
