The petitioner, who is in custody, seeks bail in connection with Patahi P.S. Case No. 191 of 2017 registered for the offences punishable under Sections 121, 121(A), 120(B) of the Indian Penal Code and 25(1-b)a, 25(1-AA), 25(1-AAA)26, 35 of the Arms Act and 3/4 Explosive Substance Act and 16, 18, 18(A), 18(B), 19, 20 of U.A.P. Act.

Informant is the Sub-Inspector of Police who stated in his self statement that on 10.12.2017 he received secret informant that some miscreants of Maowadi along with petitioner had assembled during meeting in the garden of Baliram Sahani, the informant along with Armed forces reached

Patna High Court Cr.Misc. No.34524 of 2018(4) dt.21-08-2018 2/2 there then three persons including petitioner were apprehended and rest other escaped away.

It has been submitted on behalf of the petitioner that he is not committed any offence and he has been falsely implicated in this case and nothing has been recovered from the conscious possession of the petitioner. Similarly situated coaccused namely, Mustakim @ Mustak Alam @ Muskan and Baliram Sahani have been allowed bail by co-ordinate bench of this court in Cr. Misc. No. 28253 of 2018 and Cr. Misc. No. 42696 of 2018 vide order dated 07.05.2018 and 26.07.2018 respectively. The petitioner is in custody since 11.12.2017. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 8th, East Champaran, Motihari, in connection with Patahi P.S.
