The petitioner seeks bail in connection with Sessions Trial No.12 of 2018, arising out of Sherghati (Dobhi) P.S. Case No.268 of 2016, registered under Sections 304(B)/34 of the Indian Penal Code.

Earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 08.03.2017 passed in Criminal Misc. No.6261 of 2017 on merit.

The report, as called for vide order dated 25.07.2018 passed by this Court, regarding the present stage of the aforesaid case, has been received from the court of the Additional Sessions Judge-I, Gaya, vide Letter No.451 dated 03.08.2018, from which it appears that out of the four charge-sheeted

Patna High Court Cr.Misc. No.42978 of 2018(3) dt.12-09-2018 2/2 witnesses, three witnesses have been examined and the I.O. and the Doctor are yet to be examined.

Having regard to the facts and the circumstances of the case, I find no reason to reconsider the prayer of the petitioner for grant of bail. Accordingly, the prayer of the petitioner for grant of bail stands rejected. However, the trial court is directed to conclude the trial of the petitioner within four months by taking all effective steps. If the trial of the petitioner is not concluded within four months, the petitioner would be at liberty to renew his prayer for bail. (Rajendra Kumar Mishra, J) P.S./- U
