JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 This application, for grant of anticipatory bail, arises out of Bela P.S. Case No. 9 of 2018, disclosing offences under Sections 457, 380/34 of the Indian Penal Code. Prosecution case is that the informant left the key of the house with the petitioner and there was theft of several ornaments and cash of Rs. 8,000/- and informant suspects the hands of petitioner in commission of theft.

Submission of learned counsel for the petitioner is the his father and mother works in the house of informant as servant and there was dispute between his parents and the informant with regard to payment of wages and due to which, they have falsely implicated the petitioner in this case. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge -XII-cum- ACJM, Muzaffarpur, in connection with Bela P.S. Case No. 9 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that petitioner will cooperate in investigation and if any ornament or articles recovered from the petitioner or at his instance, the prosecution will be at liberty to move for cancellation of bail bonds of the petitioner.
