JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-07-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Sessions Trial No. 408 of 2017 arising out of Charpokhari P.S. Case No. 245 of 2016 registered for the offences punishable under Sections 394 and 397 of the Indian Penal Code.
The allegation in the present case is that the accused persons including the petitioner herein had apprehended the informant of this case and snatched his motorcycle and other articles.
The learned counsel for the petitioner submits that the only material in the present case to connect the petitioner with the alleged crime is his confessional statement.
Per contra, the learned A.P.P. for the State submits that
Patna High Court Cr.Misc. No.30775 of 2018 (4) dt.23-07-2018 2/2 the confessional statement of the petitioner has led to the recovery of the stolen motorcycle, hence the complicity of the petitioner is writ large from the records.
At this juncture, the Court asked the learned counsel for the petitioner to deposit a sum of Rs. 50,000/- before the Nazarat of the concerned court for the purposes of grant of bail, to which the learned counsel has indicated in affirmative. Having regard to the facts and circumstances of the case, it is directed that the petitioner shall deposit a sum of Rs. 50,000/- (rupees fifty thousand) with the Nazarat of the concerned court and upon showing the receipt of such deposit, the petitioner, above named, shall be granted regular bail subject to such conditions as may be imposed by the learned 1st Additional District & Sessions Judge, Bhojpur at Ara in connection with Sessions Trial No. 408 of 2017 arising out of Charpokhari P.S. Case No. 245 of 2016.
The petition is disposed of.
