The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 409 of the Indian Penal Code.

The prosecution case, in brief, is that the Block Development Officer-cum-Executive Officer, Ghanshyampur submitted a written application to the SHO, Ghanshyampur alleging that in course of enquiry, it was found that the work in relation to the Jal-Nal Yojana of Ward No.02, 03, 04, 06 was found to be incomplete and of inferior quality. It was further alleged that the money was transferred in the account of ward execution and management committee, but the work was still incomplete in violation of departmental guidelines. 4.

It is submitted by learned counsel for the petitioner that

Patna High Court CR. MISC. No.68479 of 2024(2) dt.20-12-2024 2/2 petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. It is further submitted that the work has already been completed and similarly situated co-accused persons have been granted bail by this Court in Cr. Misc. No.15285 of 2024 vide order dated 21.06.2024. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his/her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Ghanshyampur P.S. Case No.66 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
