JUSTICE BIRENDRA KUMAR ORAL ORDER 21-03-2017 A supplementary affidavit has been filed by the learned counsel for the petitioner, let it be kept on the record.

Heard the learned counsel for the petitioner and the State.

This is a petition for grant of regular bail for offences under Sections 272 and 273 of the Indian Penal Code and 47(a) of the Bihar Excise Act.

From Agan Bari Center, liquor was allegedly recovered in seven bags.

Submission of the petitioner is that the petitioner has no connection with said Agan Bari Center nor the petitioner has got any criminal antecedent. More over, having similar allegation co-accused, Bashishth Kumar @ Bashishth Yadav, has already been allowed anticipatory bail by the learned Sessions Judge, Gaya, in A.B.P. No. 1 of 2017. the petitioner is in custody since 09.12.2016.

No.8366 of 2017 (4) dt.21-03-2017 2/2 Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Barachati P.S. Case No. 297 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, Sherghati, Gaya, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
