JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 11-09-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor.

On confidential information with regard to storage of wine at the orchard of Vinod Hisariyan, raid was conducted and during course thereof, one person was found over the motorcycle, having few cartons loaded who after seeing the police, began to flee but was apprehended. From the orchard 36 cartons of wine were also seized.

It has been submitted on behalf of the learned counsel for the petitioner that he was not arrested at the orchard rather he was arrested at the police station itself where he had gone to lodge an FIR relating to theft of his motorcycle. Also submitted that petitioner has got no criminal antecedent and he is in custody since 24.06.2018.

Patna High Court Cr.Misc. No.49915 of 2018 (3) dt.11-09-2018 Learned Additional Public Prosecutor opposes the same. Considering the recovery of 36 cartons of Royal Peg Premium Whiskey, for the present, prayer for bail is rejected. If so advised, petitioner may renew his prayer for bail after framing of charge.
