The petitioner seeks bail in Kishanganj Mahila P. S. Case No. 19 of 2018 instituted for the offence under Section(s) 377 of the Indian Penal Code and Sections 4 and 6 of the POCSO Act, 2012.
In the written report, it is alleged that this petitioner committed unnatural sex with the daughter of the informant aged seven days.
The case diary has been received, wherein, the Medical report of the girl is available which shows that laceration present on posterior anal region. There is evidence of unnatural sexual offence present. The doctor has assessed her
Patna High Court Cr.Misc. No.52927 of 2018(4) dt.10-10-2018 2/2 age to be 6-8 years.
In such circumstances, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.
