The petitioner is in custody since 29.07.2019 in connection with Narpatganj (Bathnaha) P.S. Case No. 725 of 2018 for the offence registered under Sections 30 (a), 36 and 38 of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not made from the conscious possession of the petitioner and the name of the petitioner has surfaced on the basis of the confessional statement made before the police, which has no evidentiary value.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
