The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 341, 353, 307, 332, 333, 120(B) of the Indian Penal Code, Section 25(1-b)A, 26(ii), 35 and 27 of the Arms Act, Section 3/4 of Explosive Substance Act, Sections 10(i), 13(ii) of U.A.P. Act and Section 17 of C.L.A. Act. The prosecution story in brief, is that on the alleged date of occurrence, when the informant reached village Mahajaria, in the meantime the petitioner along with other co-accused started opening fire upon the informant, causing injury to him. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.03.2015. The charge sheet has

The petitioner has remained in custody for more than two years. General and omnibus allegation has been made against the petitioner. There is no specific overt act has been alleged against the petitioner. The other co-accused has been granted bail vide Annexure-2 to the present application.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati at Gaya, in connection with Dumariya P.S.
