JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 This is an application for grant of anticipatory bail in connection with Maner P. S. Case No. 612 of 2018, disclosing offences under Sections 341, 323, 308, 379, 504, 34 of IPC. As per F.I.R. petitioner is said to have assaulted by rod on the head of the informant and other accused have assaulted by lathi, causing injury.
Submission of the learned counsel for the petitioner is that there is land dispute between the parties. There is case and counter case between the parties. Further submission is that there is no allegation of repetition of blow. Heard learned A.P.P. as well as learned counsel for the informant also, who has opposed the prayer for anticipatory bail on the ground that the informant was referred to PMCH, Patna
Patna High Court CR. MISC. No.65755 of 2019(2) dt.21-10-2019 2/2 and also no opinion of the injury.
Having heard both sides, considering the above submissions, this application is disposed of with a direction to the petitioner to surrender before the court below, on surrender, he will be released on provisional bail to the satisfaction of the court below, till then the learned court below shall call for case diary as well as injury report. Once considering the nature of injury found on the body of informant, he will either confirm the bail bonds or ask the petitioner to pray for regular bail. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
