The Petitioner apprehends his arrest in Chainpur P.S. Case No.07 of 2017 instituted for the offence under Section(s) 395, 412 Indian Penal Code.
It has been submitted that the name of this petitioner has been taken by co-accused, Sugriv Koeri.
As per written report, three persons armed with fire arms tied the hands of the informant and his father and loaded 41 bags of paddy on Pickup Van and proceeded towards Neura village. The police was informed and on halla one person was apprehended in the market and others managed to flee away. The apprehended persons disclosed his name as Sugriv Koeri and he
Patna High Court Cr.Misc. No.9547 of 2017 (3) dt.27-03-2017 2/2 in his confessional statement before the police disclosed the name of the petitioner and other accused persons.
In this manner, from the written report itself, it appears that there is no recovery of paddy from the possession of this petitioner.
In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Chainpur P.S. Case No.07 of 2017, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur, subject to the conditions as laid down under Section 438(2) Cr. P. C.
