Mr.Md. Ataur Rahman CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-04-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 379, 414, 420, 467, 468/34 of the Indian Penal Code. There is recovery of stolen motorcycles and parts of motorcycles from the scrap shop of the petitioner. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. It is further submitted that the petitioner runs a small scrap shop for earning his livelihood.
Patna High Court CR. MISC. No.64984 of 2022(3) dt.10-04-2023 2/2 Nothing has been recovered from the conscious possession of the petitioner. The signature of the petitioner was not taken on the seizure list. Moreover, other co-accused person has been granted bail by a co-ordinate Bench of this Court vide order dated 28.02.2023 passed in Cr. Misc. No. 65276 of 2022. The petitioner is languishing in custody since 16.08.2022.
Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Patepur P.S. Case No. 218 of 2022.
