2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act, registered in connection with Ladania P.S. Case No. 208 of 2024.

3. As per prosecution case, there has been recovery of total 270 liters of Nepali liquor from a Tempo and the petitioner was apprehended on spot.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner has no concern with the alleged recovery of liquor. Being the owner of the seized

Patna High Court CR. MISC. No.68322 of 2024(2) dt.07-10-2024 2/2 vehicle, he has been made accused in this case. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner is a person of clean antecedent and he is in custody since 09.07.2024.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case as well as petitioner having no criminal antecedent, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Excise Act, Madhubani in connection with Ladania P.S. Case No. 208 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
