JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2017 The petitioner is in custody since 02.09.2016 in connection with Agamkuan P.S. Case No. 230 of 2016, registered for offences punishable under Sections 392 and 411 Indian Penal Code.

It has been submitted on behalf of the petitioner that though some articles have been recovered from the petitioner, however the same did not tally with the list of articles prepared at the time of lodging of the case and petitioner has been in custody since 02.09.2016.

Learned counsel for the State opposed the prayer for bail and submitted that on the basis of confessional statement of this petitioner, alleged articles have been recovered and they are put on T.I.P., in which informant has identified the articles.

No.8417 of 2017 (3) dt.03-04-2017 2/2 Having heard both sides, in view of the materials available in the case diary and as in the T.I.P. articles were identified by the informant, as such, I am not inclined to grant the petitioner, the privilege of regular bail, it is accordingly rejected. However, the trial court is directed to expedite the trial and try to conclude the same within a period of nine months from today.
