Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
This application for regular bail arises out of Amarpur (Fullidumar) P.S. Case No.93 of 2022 disclosing offence punishable under Sections 341, 342, 328, 307, 504, 34 of the Indian Penal Code.
Briefly narrated the prosecution's case is that the informant's daughter was found to have consumed poison. Upon enquiry, after she had regained consciousness, she disclosed that this petitioner had commanded other persons named in the FIR to administer her poison whereafter co-accused Laxman Kumar, Nanaku Kumar and Mohan Yadav had caught hold of her and
Patna High Court CR. MISC. No.65566 of 2022(2) dt.04-03-2023 2/2 Raju Kumar had administered her poison forcibly. Learned counsel for the petitioner has submitted that Laxman Kumar has been allowed anticipatory bail by this Court by an order dated 10.02.2023 passed in Cr. Misc. No.3480 of 2023.
Since co-accused Laxman Kumar has been allowed anticipatory bail by this Court, there is no reason why this Court should decline the prayer of the petitioner for release of bail. In the facts and circumstances, as noted above, this application is allowed.
Let the petitioner above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Banka in Amarpur (Fullidumar) P.S. Case No. 93 of 2022.
