2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 303(2), 317(2) and 3(5) of the B.N.S..
3. As per prosecution case, Petitioner No. 1 is registered owner and Petitioner No. 2 is driver of the seized tempo from which parts of the seized boat were recovered.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Petitioners have falsely been implicated in this case merely on suspicion. No incriminating
Patna High Court CR. MISC. No.64347 of 2025(2) dt.16-09-2025 2/2 article has been recovered from possession of these petitioners. Petitioners claim clean antecedents.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that Petitioner No. 1 is owner and Petitioner No. 2 is driver of the seized tempo from which parts of the boat seized by the police were recovered.
6. Considering the facts and circumstances of the case and nature of accusation the prayer for grant of anticipatory bail to the petitioners is rejected.
